Sweden suspended the auction of 5G spectrum
Earlier, when the Swedish telecommunications regulatory agency announced the conditions for bidding for the 5G spectrum, operators participating in the bidding were not allowed to use equipment provided by Huawei Technologies.
At the same time, if the operators participating in the auction have already adopted Huawei equipment, they need to remove all Huawei equipment and no longer use them before January 1, 2025.
After the restriction clause was issued, Huawei and the Swedish operators expressed their opposition. At the same time, Huawei announced that it would sue the Swedish telecom regulator in a Swedish court to protect its legal rights.
After Huawei filed a lawsuit in the Stockholm Administrative Court, Sweden, the court supported it. The judge subsequently made an interim ruling to stop the Swedish telecom regulator’s policy.
This means that the operators participating in the bidding do not need to comply with the previous attachment conditions related to Huawei to continue to use Huawei equipment if the court’s provisional ruling is made.
For Huawei, the court’s interim ruling should be very timely, but then the Swedish telecommunications regulatory agency announced the suspension of the auction process and re-evaluation.
The court stated that Huawei has the right to appeal the decision of the regulatory agency, but the situation is currently unclear, so it is necessary to make an interim ruling to stop the policy.
Next, the Swedish telecommunications agency must make reasonable adjustments or make a statement in the court and obtain the court’s approval, otherwise, it cannot impose restrictions on Huawei in the auction.
At present, Huawei has not taken other legal measures apart from appealing to the court. Huawei hopes to communicate with the Swedish government to resolve the matter instead of going to court. Huawei is waiting for full communication and cooperation and constructive dialogue with relevant Swedish institutions.
As a 5G equipment supplier, Huawei is willing to cooperate in the future with regard to any requirements that may be raised by relevant Swedish institutions and make Huawei a certified supplier.
