The Ninth Circuit Court of Appeals again dismissed the U.S. Department of Justice’s request to block WeChat

Earlier, US President Trump signed an executive order requiring Apple and Google to remove WeChat from their app stores and prohibit Americans from continuing to download and install.

In order to protect their own interests, US WeChat users formed the US WeChat User Association and hired lawyers to sue the US Department of Justice in court to prevent the ban from continuing to be enforced.

Trump and the U.S. Department of Justice banned them on the grounds of endangering U.S. national security. However, in the first round, the U.S. judge believed that the U.S. Department of Justice lacked substantive evidence.

Subsequently, the judge supported the request of the lawyers to make a ruling to prevent the execution of Trump’s executive order. The US Department of Justice refused to accept the ruling and then applied it to the judge to execute the order.

After the first round of rulings, the US Department of Justice submitted to the court the so-called evidence that endangers US national security as required. However, the judge believed that the evidence submitted was insufficient.

The judge in charge of the case stated that the new evidence submitted by the U.S. Department of Justice on behalf of the U.S. government did not change the court’s views on WeChat and therefore could not support the U.S. government.

So in the end, the judge decided to still maintain the ruling made in early September to prevent the execution of the ban. After the block, Apple and Google are not allowed to release WeChat under the administrative order.

After the second round of the ruling, the U.S. Department of Justice stated that it would appeal the decision to the U.S. Circuit Court of Appeals, and the Circuit Court of Appeals will continue to handle the case.

The latest news is that the U.S. Department of Justice, which represents the U.S. government, continues to appeal to the U.S. Circuit Court of Appeals, hoping to revoke the two previous decisions made by federal judges.

The three-judge panel of the Ninth Circuit Court of Appeals has again rejected the motion submitted by the U.S. Department of Justice and refused to revoke the two previous rulings of federal judges.

This means that the Trump administration’s executive order to block WeChat will still not be executed, and Apple and Google will continue to provide WeChat download and installation in their stores.

Of course, the US Department of Justice will not give up otherwise it will not be able to explain to Trump, so the US Department of Justice will appeal this case to the Supreme Court of the United States.
